Welcome to TidyFax (“we,” “us,” “our”). By using our website and services (“Service”), you agree to these Terms of Service. If you do not agree, do not use TidyFax.

1. Overview

TidyFax provides an online tool for uploading and sending faxes. No account is required. Additional features may be added over time.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding agreements to use the Service.

3. Use of the Service

  • No unlawful, fraudulent, harmful, or abusive activity.
  • No harassing, defamatory, or inappropriate fax transmissions.
  • No PHI without a valid HIPAA Business Associate Agreement.
  • No attempts to bypass or interfere with security features.
  • No reverse engineering or misuse of the platform.

4. Fax Delivery & Limitations

We make reasonable efforts to deliver faxes quickly and reliably, but we do not guarantee delivery success due to carrier issues, recipient equipment failures, busy lines, or other external conditions.

You are responsible for verifying receipt by the intended recipient.

5. Payments & Fees

Payments are securely processed through Stripe. All charges are non-refundable once a fax attempt begins.

6. No Warranties

The Service is provided “as is” and “as available” without warranties of any kind.

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our maximum liability is limited to the amount paid for the specific fax transaction.

8. Privacy & Data Handling

Use of the Service is governed by our Privacy Policy.

9. Prohibited Content

  • PHI without a HIPAA BAA
  • Financial account numbers
  • Illegal or unauthorized copyrighted content
  • Malicious or harmful data

10. Intellectual Property

Site content, branding, code, and design are owned by TidyFax.

11. Legal Compliance

You agree to comply with all applicable laws, including U.S. telecommunications rules, state privacy requirements, and international standards when applicable.

12. Colorado-Specific Compliance (Parker / Douglas County)

This agreement is governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts located in Douglas County, Colorado.

Colorado consumer protections and digital privacy rights applicable to Colorado residents apply to this Service.

13. Modifications

We may update these Terms at any time. Continued use constitutes acceptance of changes.
